Terms of Use

1. Scope
These Terms of Use apply to the use of the engpassradar.ch website and all related services (hereinafter "Service"), operated by HM Consulting Rühe, Buchenweg 18, 5036 Oberentfelden, Switzerland.
2. Service and Purpose
engpass.radar is an information service that aggregates and processes publicly available data on drug shortages in Switzerland. The data comes from official sources (drugshortage.ch, Federal Office for National Economic Supply BWL, ODDB) and is updated automatically every day.
The Service comprises a free web interface as well as a REST API with paid access tariffs for professional and institutional use (cf. clause 10). It is aimed at healthcare professionals (pharmacists, physicians, hospital pharmacy, research) as well as software vendors in the pharmaceutical environment.
3. No Medical Advice
The information displayed on engpassradar.ch is for informational purposes only and does not constitute medical, pharmaceutical or legal advice. For specific therapeutic decisions, the responsible professionals and the respective official sources (Swissmedic, BAG, Kompendium.ch) are always authoritative.
4. Disclaimer
The operator assumes no warranty for the correctness, completeness or timeliness of the data displayed. The primary sources (drugshortage.ch, BWL, ODDB) are authoritative. The operator is not liable for damages arising from the use or non-use of the information provided.
The Service is provided without availability guarantee ("as is"). Maintenance work, data outages and changes to the scope of functions are reserved.
5. Permitted Use
Use of the Service is permitted for:
- Personal and professional information purposes in the healthcare sector
- Non-commercial research and teaching
- Journalistic reporting with source citation (engpassradar.ch)
- Internal use in hospitals, pharmacies and healthcare institutions
- Commercial software integration based on a valid paid API tariff (Professional, Institutional or Data License, cf. clause 10)
6. Prohibited Use
The following are prohibited in particular:
- Operating a commercial service based on the processed data without a valid paid tariff or written permission from the operator
- Passing on or redistributing API data as your own product without a Data License agreement (cf. clause 10.5)
- Automated mass querying of the website outside the API that impairs operation
- Circumventing rate limits (e.g. through changing IP addresses, key sharing or proxying)
- Any use that violates applicable Swiss law
The source code is subject to the Elastic License 2.0.
7. Data Sources and Copyright
The raw data comes from public sources and remains the property of the respective data providers. The processing, structuring and presentation by engpass.radar is protected by copyright.
8. Changes
The operator reserves the right to amend these Terms of Use at any time. The current version is available on this page. The date of the last change is indicated above.
9. Applicable Law
Swiss law applies exclusively. Place of jurisdiction is Aarau, Switzerland.
10. API Use and Tariffs
engpass.radar provides a REST API. The full documentation is available at engpassradar.ch/api-docs and the tariff overview at engpassradar.ch/api.
10.1 Free Tariff
The Free tariff can be used without registration and is limited to 100 requests per day per IP address. It is suitable for testing and non-productive purposes. Attribution ("Source: engpassradar.ch") is required when reusing the data.
10.2 Research Tariff
The free Research tariff (2,000 req/day) is available to universities, universities of applied sciences and Swiss hospitals. The application is made via engpassradar.ch/api-keys. A valid institutional email address or credible research evidence is required. In the event of false information, the key may be blocked without prior notice. The Research tariff may not be used for commercial products.
10.3 Professional Tariff (CHF 39/month)
For individual developers, pharmacies and small software projects. Limit: 10,000 requests per day. Commercial use is permitted, provided that the data is not redistributed unchanged. No SLA guarantee.
10.4 Institutional Tariff (CHF 199/month)
For clinics, pharmacy chains and software vendors. Limit: 100,000 requests per day. This tariff includes an availability SLA of 99.9% (measured monthly, scheduled maintenance windows excluded). Deviations entitle, on request, to a pro-rata credit, but not to claims for damages.
10.5 Data License (from CHF 499/month)
Unlimited access and the right to redistribute the data in your own products or as a data feed requires a separate, written Data License agreement. Without this, redistribution is expressly prohibited. Inquiries to api@engpassradar.ch.
10.6 API Keys and Access Credentials
- API keys may not be shared or made publicly accessible. In case of suspected misuse, the operator must be informed immediately.
- The operator reserves the right to block keys without prior notice in the event of a violation of these terms. In this case, the right to a refund of ongoing subscription fees lapses.
- Authentication is via magic link (JWT, valid for 30 days). No password storage takes place. The user is responsible for the security of their email address.
10.7 Changes to the API
Changes to endpoints, data formats or rate limits are communicated by email with at least 14 days' advance notice. Breaking changes are announced with at least 30 days' lead time.
11. Payment Terms
11.1 Billing
Paid tariffs are billed monthly or annually in advance. Payment processing is handled by Stripe Payments Europe Ltd. ("Stripe"). By concluding a subscription, the user additionally accepts the Stripe Terms of Service.
11.2 Cancellation
Monthly subscriptions can be cancelled at any time at the end of the current billing month. Annual subscriptions can be cancelled at the end of the contract year. Cancellation is made via the customer portal (accessible via the magic link in the dashboard). After cancellation, access remains until the end of the period already paid for.
11.3 Refunds
Already paid billing periods are generally not refunded, unless the Service was unavailable for more than 72 hours continuously (Institutional tariff: 99.9% SLA). In justified individual cases, the operator decides at its reasonable discretion.
11.4 Price Changes
Price changes are communicated to existing subscribers by email with at least 30 days' advance notice. In case of disagreement, the subscription can be cancelled before the new prices take effect.
